About this good practice
MODERA is born as a private good practice, being the first private center dedicated to the negotiation and business mediation in the Region of Murcia. MODERA makes availabe to entities and individuals the wide experience of their professionals in the implementation of negotiated solutions, promoting a true culture and promote friendly solutions. The approach of the company is to work in prevention and management conflicts in a business organization.
1.Mainstreaming occasional conflicts’ management with dynamics and coaching that allows to avoid re-emergence of the conflict: Mediation / Arbitration / Trial 2.Strategic negotiation 3.Mentoring of conflict management 4.Multiparty. The stakeholders are MODERA’s founding members (Rosa Vigueras, Helena Ruiz, and Javier Cabrera) are, having acquired our professional experience in the INTRAJUDICIAL MEDIATION UNIT IN MURCIA- UMIM, a unit that is integrated in the Superior Justice Court of Murcia. In addition, they collaborate with the Social Corporate Responsibility cathedra, at Murcia University delivering an entrepreneurial mediation course.

Nowadays, most conflicts are resolved through the courts of justice through a process. But in many cases, the judicial process does not respond adequately to the expectations demanded, and so the importance of establishing adequate mechanisms is recognized by the evolution of the social conscience in Spain regarding the extrajudicial resolution of conflicts, that are increasing.
Potential for learning or transfer
The main reason why we choose this good practice is to enhance the possibility of regional and national governments around Spain and specifically in the Region of Murcia to develop a similar or comparable law –to help entrepreneurial debtors-
