About this good practice
In line with the functions of the Director of Contracts, the Department of Contracts (DoC) regularly publishes Procurement Policy Notes (PPNs) with the scope of clarifying and supplementing the Public Procurement Regulations. The said Procurement Policy Notes started being published on 02 December 2013, when at the time, the Legal Notice in force was LN 296 of 2010. However, on 28 October 2016, the Government of Malta published LN 352 of 2016, repealing LN 296 of 2010.
The Procurement Policy Notes and Circulars issued by the Department of Contracts in Malta aim to address the definition gaps in legislation concerning fundamental terms related to GPP and establish a common set of technical, environmental and managerial principles underlying tendering procedures.
Furthermore, they aim at providing guidance on best practice for public sector procurement. So far 39 Procurement Policy Notes have been published.
All the Procurement Policy Notes are accessible through the Department of Contracts’ website under the ‘Publications’ section (http://contracts.gov.mt). In addition, in line with Contracts Circular No. 03/2018 (dated 16 February 2018), in order to promote the publication of Procurement Policy Notes, the Department has endeavoured to publish
a quarterly Contracts Circular providing a list of new/updated/repealed policies.

Resources needed
No financial resources/funding as such is required for this best practice. However, staff time will be required for drawing up the procurement policy notes according to policy specifications and the law (estimation: 25 – 50 hours depending on the nature of the procurement note including review).
Evidence of success
In total 39 procurement policy notes applicable to all contracting authorities in Malta have been issued since 2013.
Potential for learning or transfer
The collection available online brings together all procurement policy notes published by the Department of Contracts in Malta since 2013, providing guidance on best practice for public sector procurement. They are available in English and can therefore be easily adapted by other European regions and public sector stakeholders.
