About this good practice
RENACE is a public programme of advice, financing and helping entrepreneurs and proffesionals to, by out-of -court settlement, reducing or eliminating the financial charges incurred during financial crisis period. Always with the aim of enabling them to start a new business project or join the labour market. This program born to reduce or even eliminate debts of employers and good faith entrepreneurs whose business closed. All of this thanks to a real program of exoneration of the accumulated debts through out-of-court agreements facilitated by the public administration. RENACE promotes re-entrepreneurship starting up new projects or incorporation to the labour market and also gives access to reimbursers to a complete professional program to help them in the new business decision making process.
People, who are in a situation of insolvency and are interested in restarting a business activity, can go to the RENACE Office located in the facilities of INFO (Regional Development Agency of the Region of Murcia) and, if interested in the service, they must submit an application request. The instance can be presented by a business person or a non-business person.
RENACE office diagnoses in an Optimization or Feasibility Report if the second chance law process. Presented the documentation, a bankruptcy mediator is appointed: the mediator will promote the negotiations to obtain the expected Out of court Payment Agreement that may include: withdrawals or waits.

Expert opinion
This is a good example of a practice that seeks to help entrepreneurs whose businesses have failed due to economic crisis and have difficulties re-starting entrepreneurial activity. The ultimate aim is to tap into the potential of these entrepreneurial people and support second chance re-entrepreneurship. Participants in the programme receive advice and technical support to settle the debt accumulated by their businesses and to return to activity in the same conditions that a new entrepreneur. Although this practice has been around since 2017, it is even more relevant now due to the financial difficulties caused by the Covid-19 virus and subsequent lockdowns.

The programme has a budget of € 110.107 (ERDF funds), destined to subcontracting the lawyers who analyze the documentation of the applicants and prepare the viability report of the files.

Evidence of success
In total, 11 companies and 122 self-employed (83 men and 39 women) have taken up RENACE plan and have received advice and technical support to settle the debt that their businesses accumulated and to return to activity in the same conditions that a new entrepreneur.
Of these 133 cases, 77 have been concluded by now. The 89% of them have achieved a solution. Just in 8 cases has been impossible to restructure the debt by the company.

Potential for learning or transfer
In Spain, as many countries around Europe, we have a national law to support the second chance re-entrepreneurship. However, legislative efforts have not been as planned. The potential for transfer of this good practice is to transfer to the public administration the responsability to make available for every debtor the second chance; implementing a special service of attention for re-entrepreneurs, that needs to be effective on the implication of the entities that have to participate in the operation of the second chance mechanisms that the Law establishes and those interested in the object of this project.
